About Elsen Law

Born and raised in Missoula Montana, I did not fully appreciate how special my hometown was until I left for college. I graduated from Wheaton College in 2002 with a BA in Political Science and a minor concentration in Chemistry. I rowed for the Wheaton Crew team all four years at Wheaton and was the rowing captain in my junior and senior years. After Wheaton, I taught English in China for two years before coming back to Wheaton to work for its center for leadership development. After earning a MA at Wheaton, I worked for another leadership development organization for several years in the Wheaton area. In 2018 I moved back to Missoula to attend law school earning my JD in 2021. During law school, I worked as a legal intern for a law firm in Missoula and did my clinical work at the Veterans Advocacy Clinic. After graduation, I worked at the law firm I interned with for a couple more years until starting Elsen Law in 2023.

01 What legal services does Elsen Law Firm provide?

Elsen Law Firm represents individuals, families, and businesses in estate planning, business law, property law, and civil litigation. Attorney Daniel Elsen provides practical, personalized guidance for matters such as wills and trusts, contracts and operating agreements, property disputes, landlord-tenant issues, business conflicts, and other civil legal matters.

02 When should I speak with an attorney about an estate plan?

Estate planning is useful at many stages of life—not only after retirement. You may benefit from speaking with an attorney when you acquire property, start a family, build a business, experience a marriage or divorce, receive an inheritance, or want greater control over how your assets and responsibilities will be handled. A Montana estate planning attorney can help you build a plan around your family, property, and goals.

03 Do I need a will, a trust, or both?

The right documents depend on your assets, family structure, privacy concerns, and long-term goals. A will can direct the distribution of property and name important decision-makers. A trust may offer additional control over how assets are managed and transferred. Because no single document fits every situation, Elsen Law develops estate plans tailored to the client rather than relying on a generic template.

04 How can a business attorney help prevent future disputes?

Clear agreements often prevent expensive misunderstandings. Elsen Law helps Montana businesses draft and review contracts, operating agreements, and transaction documents; clarify ownership and responsibilities; identify legal risk; and address developing conflicts before they escalate. Early legal guidance can protect working relationships and give a business a stronger foundation for growth.

05 What kinds of property disputes does Elsen Law handle?

Property disputes can involve boundary and access questions, disagreements between owners or neighbors, landlord-tenant matters, contracts, and other conflicts involving the use or ownership of real property. Elsen Law evaluates the documents, facts, and practical stakes of the dispute, then works toward an efficient resolution through negotiation or litigation when necessary.

06 What is civil litigation?

Civil litigation is the legal process used to resolve non-criminal disputes between individuals, businesses, or other parties. It may involve business disagreements, contract disputes, property matters, personal injury claims, or other civil conflicts. Many cases are resolved through negotiation or settlement, while others require court proceedings. Elsen Law helps clients understand the available paths and prepare for each stage.

07 Will my legal dispute have to go to trial?

Not every dispute goes to trial. Depending on the facts and the parties involved, a matter may be resolved through direct negotiation, a structured settlement, mediation, or another form of dispute resolution. When litigation is necessary, careful preparation remains essential. Elsen Law evaluates both the legal and practical considerations so you can make informed decisions as the matter develops.

08 Why hire a local Missoula attorney?

A local attorney understands the community and the practical context surrounding legal matters in Western Montana. Daniel Elsen was born and raised in Missoula and provides clients with direct, responsive representation. Working with Elsen Law means receiving advice from the attorney handling your matter, with a strategy shaped around your specific circumstances rather than a one-size-fits-all process.

09 What should I bring to my first meeting with an attorney?

Bring any documents that help explain the matter, such as contracts, deeds, correspondence, court papers, business records, prior estate planning documents, photographs, and a simple timeline of key events. It is also helpful to write down your questions and desired outcome. The firm can tell you if additional information is needed for your particular consultation.

10 How do I get started with Elsen Law Firm?

Contact Elsen Law to briefly describe your legal matter and request a consultation. The firm will gather the initial information needed to determine the appropriate next step. Reaching out early can give you more time to understand your options, preserve important information, and avoid decisions that could complicate the matter.
